Cabinet, DPP to deliberate revision to Civil Code

Taipei, May 24 (CNA) Following a Republic of China Constitutional Court ruling that the Civil Code is unconstitutional in not ensuring same-sex marriage rights, Cabinet spokesman Hsu Kuo-yung said on Wednesday that the Executive Yuan respects the interpretation and will draft a proposal for revising the laws.

The court's historic interpretation requires the Legislature to amend the relevant laws within two years to protect the right to marriage freedom and to equality for the lesbian, gay, bisexual and transgender (LGBT) community.

Premier Lin Chuan has ordered Chen Mei-ling, secretary-general of the Executive Yuan, to coordinate the Ministry of Justice, Ministry of Interior and other branches to draft the revision proposal, said Hsu.

The Cabinet will deliberate based on the principle of pursuing consensus among the majority and impacting society the least, and will submit a "reasonable and practical" proposal to the Legislature, Hsu added.

In response to a question of whether the Cabinet will submit a proposal covering same-sex marriage in the Civil Code or specify the issue in a separate law, Hsu said the interpretation does not rule out either option, so this will be decided upon after deliberation.

Meanwhile, the ruling Democratic Progressive Party (DPP) said it welcomed the interpretation. The party supports marriage equality and will promote all draft bills for marriage equality, said DPP spokesman Juan Chao-hsiung.
