Taipei City to grant gay employees marriage, paternity leave

Taipei, July 19 (CNA) The Taipei City government has become the first local government in Taiwan to grant gay employees marriage and paternity leave if they register their relationship at a household registration office.

Taipei Mayor Ko Wen-je said on Wednesday that because the Civil Code has yet to be amended within two years following a Constitutional Court ruling upholding same-sex marriage, marriage and paternity leave rules have yet to be revised in the private sector.

But gay public sector employees will now be allowed to take marriage and paternity leave if their marriages are officially registered, Ko said.

In its Interpretation No. 748 issued on May 24, Taiwan's constitutional court ruled that the prohibition of same-sex marriage in the Civil Code violated the Constitution.

The ruling gave government authorities two years from the date of the Interpretation to amend existing legislation or enact relevant laws to align them with constitutional norms.

It also left it up to the discretion of the authorities to determine how to achieve the equal protection of the freedom of marriage for two persons of the same sex.

The issue is being debated in the Legislative Yuan, but no new legislation or revisions to old laws have as yet been passed.
